These Terms of Service (hereinafter referred to as “TOS”) record the terms and conditions that apply to your (“user,” “you,” “your”) access and use of the website “https://mojek.money” and its mobile applications, which may be available on Android and iOS platforms (collectively referred to as the “Platform”). The Platform is operated by Mojek Solutions Private Limited (hereinafter referred to as “Company,” “Mojek,” “We,” or “Us”), incorporated under the laws of India and registered under the Companies Act, 2013.
Through this Platform, Mojek provides personal finance services in collaboration with SHREEM DATATECH SOLUTIONS PVT. LTD., a Registered Investment Advisor (RIA). All financial data accessed through Mojek’s services is securely managed and stored on Shreem DataTech’s servers, while Mojek simply displays the information locally on your device for your personal use. By using this Platform, you agree to the terms set forth in this TOS and acknowledge the partnership between Mojek and Shreem DataTech for data handling purposes.
By accessing the Platform or using the Services (defined below), you agree to be bound by these TOS, all applicable laws and regulations, and accept responsibility for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform and the Services. The materials and content contained on this Platform are protected by applicable copyright and trademark law.
These TOS, along with our Privacy Policy available at “https://mojek.money/privacy-policy” (“Privacy Policy”), describe our relationship with you and are subject to the rules, guidelines, policies, terms, and conditions applicable to any specific service provided through this Platform. These shall be deemed incorporated into this TOS as an integral part.
This document is an electronic record in terms of the Information Technology Act, 2000 (“IT Act”), as amended from time to time, and the applicable rules thereunder, as well as the amended provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signatures.
By accepting these TOS, you hereby declare and confirm that:
• You are a resident of India.
• You are at least 18 (eighteen) years of age or older.
• You have the capacity to enter into a legally binding contract as per the Indian Contract Act, 1872.
• You have not been previously suspended or removed by Mojek or any of its affiliates from availing the Services, nor have you been disqualified from availing any Services.
• You do not, and will not, impersonate any person or entity, nor falsely state or misrepresent any person’s or entity’s identity.
• You are not barred or otherwise legally prohibited from accessing or using the Platform by Mojek or its affiliates, or under the laws of India or any applicable law.
If you represent an entity, organization, or any other legal person (not being a natural person), you confirm and represent that you are duly authorized by the organization, entity, legal person, or management of such organization, entity, or legal person to accept these TOS and have the necessary power and authority to bind such entity, organization, or legal person to these TOS.
The Services provided by Mojek include the operation of the Platform, personalized spend analysis, and access to various financial products, services, web-based tools, and other related activities (collectively referred to as “Services”).
The Services may also include services, content, documents, and information owned by, licensed to, or otherwise made available by third parties or our affiliates (“Third Party Services”), and may contain links to these Third Party Services. You understand and acknowledge that responsibility for Third Party Services lies with the respective third-party or affiliate providing those services.
You agree and acknowledge that certain Services, including Third Party Services, may be subject to additional guidelines, terms, policies, or disclaimers issued by us, third parties, or affiliates from time to time in relation to the respective Service (“Additional Terms”). Such Additional Terms shall be read in conjunction with these TOS, and in the event of a conflict between these TOS and any Additional Terms, the Additional Terms shall prevail.
We reserve the right to introduce new services or features at any time as part of the Services offered on the Platform, and such additions will also be governed by these TOS, unless otherwise stated. By continuing to use our Platform, you agree that any new Services or features introduced after your initial acceptance of these TOS will also be subject to these TOS.
Mojek reserves the right to modify these TOS or add new terms and conditions at any time for the use of the Services and Platform. While we endeavor to notify users of significant changes to the TOS, you acknowledge that it may not always be possible to provide advance notice for every modification. It is your responsibility to periodically review these TOS to stay informed of any changes. Your continued use of our Services after any updates or additions signifies your acceptance of the modified terms. If you do not agree to any changes or additions, you should discontinue your use of our Services.
To access the Services, you must register on the Platform and provide us with accurate and complete information. Mojek reserves the right to terminate any account found to contain incorrect or outdated information.
When creating an account, you shall ensure that you do not infringe upon the intellectual property rights of any third party.
You are solely responsible for maintaining the confidentiality of your password and login ID, which allow you to access the Platform and Services. You are responsible for all activities conducted through your account or password.
You agree to notify Mojek immediately of any unauthorized use of your account or any other security breach. Mojek shall not be liable for any unauthorized access to or use of your account.
Mojek does not accept any responsibility or liability for any loss or damage you may incur if any information, documentation, material, or data provided to avail the Services is incorrect, incomplete, inaccurate, or misleading, or if you fail to disclose any material fact.
We reserve the right to disable your access to your account if we suspect you are in breach of any provision of these TOS, applicable law, or if there is any actual or suspected unauthorized access to your account.
While certain Services may be provided free of charge, Mojek reserves the right to charge service fees for certain Services, subject to statutory limits (if any).
By using the Platform and providing your personal/contact details, you agree that you are interested in the services, offers, campaigns, etc., that Mojek or any third party may offer, provide, or share with you from time to time through any means, including but not limited to telephone, SMS (short messaging service), email, WhatsApp, or any other messaging service/mobile application, as well as other physical, electronic, or digital methods.
You specifically understand and agree that by using the Platform, you authorize Mojek, its affiliates, partners, and third parties to contact you for any follow-up calls related to the Services provided through the Platform, and for offering or inviting your interest in availing other products or services offered by Mojek or such third parties. You consent to receiving these communications on the phone/mobile number provided by you on the Platform and expressly waive any registration or preference under DND/NCPR lists under applicable TRAI regulations.
You will indemnify and hold harmless Mojek and the SMS/email service provider, including its officials, from any damages, claims, demands, proceedings, losses, costs, charges, and expenses whatsoever, including legal charges and attorney’s fees, which Mojek or the SMS/email service provider may incur, sustain, or suffer as a result of or arising out of any of the following:
• misuse by you; or
• incorrect, improper, or fraudulent information provided by you; or
• providing an incorrect number or a number that belongs to an unrelated third party.
You agree and authorize Mojek to share your information with its group companies, vendors, service providers, and other third parties, as needed for marketing purposes, offering various products and services, or providing you with value-added services in connection with the services selected by you or as part of Mojek’s general offerings.
In relation to Mojek Services, you agree to receive communications via email, telephone, and/or SMS from Mojek or third parties. You also agree that Mojek reserves the right to share your details with partner banks, financial institutions, vendors, service providers, business partners, agents, or other third parties, who may contact you with relevant information through email, telephone, and/or SMS.
You further acknowledge that you are responsible for the accuracy of the contact details provided to us and agree to update Mojek on any changes to your contact information.
We partner with account aggregators licensed by the RBI, including SHREEM DATATECH SOLUTIONS PVT. LTD. (a Registered Investment Advisor), to provide secure access to your financial information through Third Party Services.
To deliver certain Services, Mojek may integrate or redirect you to third-party products or services through the Platform. For bank account data and specific investment details, your consent is provided directly to Shreem DataTech Solutions, which securely manages and stores this information. For other investment details and credit card data, consent is provided directly to Mojek. You may be required to accept additional terms and meet specific requirements set by these third parties in order to access these Third Party Services. Any redirection to a third-party page will be governed by the terms and conditions of the respective third party, and Mojek will not be responsible for their practices or content.
You acknowledge that Shreem DataTech Solutions or Mojek do not bear responsibility for the actions, omissions, or negligence of other third parties. Mojek, as the provider of the Platform, disclaims any responsibility for direct or indirect damage or loss caused or alleged to be caused by the use of or reliance on any Third Party Services outside of Mojek’s partnership arrangements. We make no representations and disclaim all warranties and liabilities arising out of or related to such Third Party Services, including their accuracy or completeness.
Your interaction with any third party accessed through the Platform is at your own risk, and Mojek will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches, or negligence of such third parties or for any personal injuries, property damage, or other damages or expenses resulting from your interactions with these third parties.
You acknowledge and agree that Mojek and its partners own or are otherwise licensed to all rights, title, and interest in and to the Platform, including any intellectual property rights subsisting in the Platform (whether registered or not). Specifically, ownership of financial data is designated as follows:
• Bank data and Mutual Fund data: owned by SHREEM DATATECH SOLUTIONS PVT. LTD., which also handles its secure processing and storage. • Credit Card and Investment data (e.g., equities, ETFs, crypto, and other investments): owned by Mojek.
Mojek displays data owned by Shreem on your device but does not process or store it on Mojek’s servers. Any processing related to bank and mutual fund data is exclusively handled by Shreem DataTech.
The Services may contain confidential information designated by Mojek, which you agree not to disclose without Mojek’s prior written consent. You shall use the Platform only as expressly permitted in these TOS.
Subject to your compliance with these TOS, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to use the Services in accordance with these Terms. Under this license, you may not:
• Modify or copy the materials.
• Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
• Attempt to decompile or reverse engineer any software contained on Mojek’s Platform.
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or “mirror” the materials on any other server.
• Infringe, violate, or misappropriate any proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets, of any party.
• Except as provided hereunder, copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, create derivative works from, or license the Platform.
• Use the Platform to transmit any data or upload any material containing viruses, trojan horses, worms, or other harmful programs or code.
• Use any robot, spider, other automated device, or manual process to monitor or copy the Platform or Services or any portion thereof.
• Engage in systematic retrieval of content from the Platform to create or compile a collection, compilation, database, or directory.
• Upload or transmit information or content that is obscene, pornographic, invasive of privacy, harmful to children, or otherwise illegal or misleading.
• Threaten the unity, integrity, defense, security, or sovereignty of India, or public order, or incite cognizable offenses or insult another nation.
• Use the Services in any unlawful manner or in any manner inconsistent with these TOS.
• Take any action that may adversely affect the Services or Platform.
• Violate Applicable Laws in any manner.
This license shall automatically terminate if you violate any of these restrictions. Upon termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
Except as stated in these TOS, nothing in these TOS shall be construed as conferring any rights or licenses to Mojek, Shreem DataTech, or any third party’s intellectual property rights.
The use of the Services and the Platform is at your sole risk. You accept full responsibility for any consequences that may arise from your use of the Services or the Platform and expressly agree and acknowledge that Mojek shall have no liability with respect to the same.To the fullest extent permissible by law, Mojek and its related parties each disclaim all liability to you for any loss or damage arising out of or due to:
• your use or inability to use, or availability or unavailability of the Services, including any Third Party Services;
• the occurrence or existence of any defect, interruption, or delays in the operation or transmission of information to, from, or through the Services or the Platform, communications failure, theft, destruction, or unauthorized access to Mojek’s or third-party servers, records, or other infrastructure relating to the Services or the Platform;
• the failure of the Services or the Platform to remain operational for any period of time; and
• the collection or processing of data by Shreem DataTech or Mojek, as applicable.
Mojek reserves the right to discontinue or suspend, temporarily or permanently, the Services, including ancillary services offered on the Platform, by providing reasonable notice where possible, except when changes are required to maintain the security and integrity of the Platform. You agree that Mojek will not be liable to you in any manner for any modification or discontinuance of the Platform.
You agree not to use the Services or ancillary services offered on the Platform for illegal purposes or for the transmission of material that is unlawful, harassing, libelous, invasive of another’s privacy, abusive, threatening, obscene, or infringes the rights of others.
The materials on the Platform are provided on an “as is” basis. Mojek makes no warranties, expressed or implied, and disclaims all other warranties, including without limitation implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other rights.
Mojek makes no warranty or representations concerning the accuracy, likely results, or reliability of the use of the materials on the Platform or otherwise related to such materials or on any sites linked to the Platform.
Mojek expressly disclaims any obligation that:
• the content will be up-to-date, complete, accurate, or applicable to your circumstances;
• the Platform will meet your requirements or be available on an uninterrupted, timely, secure, or error-free basis;
• the results obtained from the use of the Platform or any Services will be accurate or reliable; or
• the quality of any products, services, information, or other material obtained by you through the Platform will meet your expectations.
Any content provided by Mojek on the Platform for general awareness does not constitute investment advice, endorsement, or solicitation. Such content is derived from publicly available sources, and Mojek cannot verify or confirm the genuineness, authenticity, or accuracy of such information.
While availing any of the payment methods available on the Platform, Mojek shall not be responsible or assume liability for any loss or damage arising directly or indirectly due to:
• lack of authorization for any transaction(s);
• payment issues related to the transaction;
• illegitimacy of the payment methods (e.g., credit/debit card fraud); or
• transaction declines for any other reason(s).
Mojek reserves the right to conduct additional verification for security or other reasons if not satisfied with the credibility of your transaction.
Use of the payment facilities provided by the Platform does not render Mojek liable or responsible for any non-delivery, non-receipt, non-payment, damage, breach of representations, non-provision of after-sales services, or fraud regarding the Services listed on the Platform. Mojek shall not be responsible for any damages, interests, or claims arising from the non-processing of a transaction.
You agree to provide accurate information, such as credit/debit information, for purchasing any Service or product on or through the Platform. You further warrant that you will not use payment information or an instrument that is not lawfully owned by you.
In addition to these TOS, the terms and conditions of the bank or other financial institution also apply to every user. The Platform disclaims any liability arising from declined payments by banks or financial institutions.In addition to the above, all disclaimers specified under any Additional Terms for a specific Service shall be deemed included in these TOS.
To the extent permissible under applicable law, we reserve the right, in our sole and absolute discretion, to suspend or terminate your use of one or more Services offered on the Platform or your account without notice and without liability to you or any third party. This may occur for various reasons, including, but not limited to, inactivity, violation of these TOS, applicable law, or other policies we may publish from time to time.
Any such termination may also result in the termination of Services provided by third parties who have partnered with Mojek, including SHREEM DATATECH SOLUTIONS PVT. LTD. Mojek shall not be held liable for any consequences arising from the discontinuation of such third-party services, as they are governed by separate terms and agreements beyond Mojek’s control.
These TOS and any rights or licenses granted hereunder may not be transferred or assigned by you. However, Mojek may assign, in whole or in part, the benefits or obligations of these TOS without requiring your prior consent.
Unless otherwise expressly stated in this Agreement, any failure to exercise or delay in exercising a right or remedy under these TOS will not constitute a waiver of that right or remedy, nor a waiver of any other rights or remedies. Similarly, no single or partial exercise of any right or remedy under these TOS will prevent any further exercise of that right or remedy or the exercise of any other right or remedy.
Mojek reserves the right to revise these TOS and to add new or additional terms or conditions on the use of the Services at any time without notice. Your continued use of the Platform shall be deemed to indicate your acceptance of the updated TOS as applicable at the time of use. If you do not agree to any changes, you may discontinue your use of the Services offered on the Platform.We also reserve the right to suspend, withdraw, or restrict the availability of all or any part of our Platform or the Services for business and operational reasons without liability.
If any provision of these TOS is found to be unlawful, void, invalid, or otherwise unenforceable, that provision will be limited or eliminated to the minimum extent required to comply with applicable law, and the remaining provisions will continue to be valid and enforceable.
Upon termination of these TOS, your account, or any Services, any provisions of these TOS which, by their nature or express terms, are intended to survive will continue to apply, including as they relate to any transactions or relationships established prior to such termination or expiration.
You acknowledge and agree that Mojek may need to modify the Services or the Platform to comply with applicable laws and regulations. As a result, you may be unable to access or use all or certain parts of the Services or the Platform. Mojek shall not be liable to you for any inability to use the Services or the Platform arising from our compliance with applicable laws.
These terms and conditions are governed by and construed in accordance with the laws of the Republic of India. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction to adjudicate any disputes that arise out of or in connection with these TOS or your use of the services offered by Mojek.
